1. Acceptance of Terms
By accessing or using the services provided by Neram Classes ("Company", "we", "us", or "our"), including our website at neramclasses.com, mobile applications, student portal at app.neramclasses.com, and all related services (collectively, the "Services"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not access or use our Services. These Terms constitute a legally binding agreement between you and Neram Classes. By enrolling in any course, making a payment, or creating an account, you acknowledge that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy and Refund Policy, which are incorporated herein by reference.
2. Definitions
"Student" refers to any individual who enrolls in or accesses courses offered by Neram Classes. "Lead" refers to any individual who submits an application or inquiry through our platform. "Services" means all educational content, coaching sessions, study materials, online tools, assessments, demo classes, and any other offerings provided by Neram Classes. "Platform" refers to our websites, web applications, mobile applications, and any other digital medium through which we deliver our Services. "Content" includes all course materials, video recordings, documents, presentations, question banks, mock tests, and any other educational or informational material provided through our Services. "Account" means the user account created on our Platform using Firebase Authentication (Google Sign-In, Phone OTP) or Microsoft Authentication.
3. Eligibility
Our Services are available to individuals who are at least 14 years of age. If you are under 18, you must have the consent of a parent or legal guardian to use our Services. By using our Services, you represent and warrant that you meet the eligibility requirements and that the information you provide during registration is accurate and complete. We reserve the right to refuse service to anyone at our sole discretion.
4. Enrollment Terms
Enrollment in any course offered by Neram Classes is subject to application approval by our administration. Submission of an application does not guarantee admission. The Company reserves the right to approve, reject, or waitlist any application at its sole discretion. Upon approval, the student must complete the fee payment within the specified deadline to confirm enrollment. Failure to pay within the deadline may result in cancellation of the enrollment offer. Seat availability is limited, and enrollment is confirmed only upon successful payment. The Company may offer scholarships at its discretion, and scholarship terms are subject to separate conditions.
5. Payment Terms
All fees are quoted in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise. Payments can be made through our approved payment gateway (Razorpay) via UPI, Credit/Debit Cards, Net Banking, or through Direct UPI/Bank Transfer. The Company offers Full Payment and Installment Payment options as determined by the administration for each student. Full payment may include an additional discount as specified at the time of payment. Installment payments must be completed within the specified due dates. Failure to pay installments on time may result in late fees, suspension of access to Services, or termination of enrollment. All payment-related disputes must be raised within 7 days of the transaction. Coupon codes and promotional discounts are subject to specific terms and may be modified or withdrawn at any time without prior notice.
6. Refund Policy Summary
Refund requests must be submitted within 24 hours of payment completion. A processing fee of 30% of the paid amount will be deducted from all approved refunds. 7. Data Collection and Usage
By using our Services, you consent to the collection, storage, and processing of your personal data as described in our Privacy Policy. We collect personal information including but not limited to: name, email address, phone number, date of birth, educational background, location data, payment information, and academic performance data. We use this data for: (a) providing and improving our Services; (b) personalizing your learning experience; (c) communicating with you about courses, schedules, and updates; (d) marketing and promotional purposes, including sending newsletters, course recommendations, and special offers via email, SMS, WhatsApp, and in-app notifications; (e) product enhancement, analytics, and research to improve our educational offerings; (f) generating anonymized aggregate data for market research and reporting; (g) complying with legal obligations. You may opt out of marketing communications at any time, but transactional communications related to your enrollment will continue.
8. Communication Consent
By registering on our Platform, you expressly consent to receive communications from Neram Classes through multiple channels including: email, SMS, WhatsApp messages, Telegram notifications, in-app notifications, and phone calls. These communications may include enrollment updates, payment reminders, course schedules, study materials, promotional offers, event invitations, feedback requests, and system notifications. You acknowledge that some communications are essential for service delivery and cannot be opted out of. Marketing communications can be opted out of through your account settings or by contacting support.
9. Intellectual Property
All content provided through our Services, including but not limited to course materials, video recordings, presentations, question banks, mock tests, study guides, software tools, and website content, is the exclusive intellectual property of Neram Classes and is protected by copyright, trademark, and other intellectual property laws of India. You are granted a limited, non-exclusive, non-transferable license to access and use the content solely for your personal educational purposes. You shall not: (a) reproduce, distribute, or publicly display any content; (b) record, screenshot, or capture any live or recorded sessions; (c) share login credentials or course materials with third parties; (d) use any content for commercial purposes; (e) modify, adapt, or create derivative works from our content; (f) reverse engineer any software or tools provided through our Platform.
10. User Obligations
As a user of our Services, you agree to: (a) provide accurate and complete information during registration and enrollment; (b) maintain the confidentiality of your account credentials; (c) attend scheduled classes and assessments as per the course calendar; (d) treat all staff, teachers, and fellow students with respect and courtesy; (e) comply with all rules and regulations of the institution; (f) not engage in any activity that disrupts the learning environment; (g) promptly notify us of any changes to your personal information; (h) use the Platform and Services only for lawful purposes.
11. Prohibited Conduct
You shall not: (a) use our Services for any fraudulent, illegal, or unauthorized purpose; (b) impersonate any person or entity; (c) harass, abuse, or threaten other users, staff, or teachers; (d) upload or transmit viruses, malware, or any harmful code; (e) attempt to gain unauthorized access to our systems or data; (f) interfere with the proper functioning of the Platform; (g) share, sell, or distribute course materials or access credentials; (h) use automated tools, bots, or scripts to access our Services; (i) post defamatory, obscene, or offensive content; (j) violate any applicable local, state, national, or international law. Violation of these terms may result in immediate termination of your account and enrollment without refund.
12. Scholarship Terms
Scholarships offered by Neram Classes are subject to the following conditions: (a) eligibility is determined by the administration based on criteria including academic performance, financial background, and school type; (b) scholarship applications require submission of supporting documents which must be genuine and verifiable; (c) submission of fraudulent documents will result in immediate disqualification and potential legal action; (d) scholarship amounts and percentages are at the sole discretion of the administration; (e) scholarships may be revoked if the student fails to meet academic or attendance requirements; (f) scholarship benefits are non-transferable and apply only to the specific course and term for which they are granted.
13. Limitation of Liability
To the maximum extent permitted by applicable law, Neram Classes and its directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or opportunities, arising out of or in connection with your use of our Services. Our total liability for any claim arising from these Terms or your use of Services shall not exceed the total amount of fees paid by you to Neram Classes in the 12 months preceding the claim. We do not guarantee admission to any college or university, specific exam scores, or particular academic outcomes.
14. Indemnification
You agree to indemnify, defend, and hold harmless Neram Classes, its directors, officers, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any third-party rights; (d) any content you submit or transmit through the Platform; (e) your negligent or wrongful conduct.
15. Dispute Resolution
Any dispute, controversy, or claim arising out of or relating to these Terms or the breach thereof shall first be attempted to be resolved through good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within 30 days, it shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in Chennai, Tamil Nadu, India. The language of arbitration shall be English. The decision of the arbitrator shall be final and binding on both parties. Subject to the above, the courts of Chennai, Tamil Nadu shall have exclusive jurisdiction over any disputes arising from these Terms.
16. Modifications to Terms
Neram Classes reserves the right to modify, update, or change these Terms at any time without prior notice. The updated Terms will be effective immediately upon posting on our Platform. Your continued use of the Services after any modifications constitutes your acceptance of the updated Terms. We recommend that you review these Terms periodically. Material changes will be communicated via email or in-app notification.
17. Termination
Neram Classes may terminate or suspend your access to the Services at any time, with or without cause, and with or without notice. Grounds for termination include but are not limited to: violation of these Terms, non-payment of fees, academic misconduct, disruptive behavior, or fraudulent activity. Upon termination, your right to use the Services will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, indemnification, limitation of liability, and dispute resolution.
18. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, including but not limited to the Information Technology Act, 2000, the Indian Contract Act, 1872, and the Consumer Protection Act, 2019. Any rights not expressly granted herein are reserved by Neram Classes.
